From student to an entrepreneur to indefinite leave to remain

We acted for a Korean national who entered the UK as a student and has continued to have leave to remain since her entry. Prior to the expiry of her final period of leave, she applied for a variation of leave to remain on the basis of post-study work and her application was successful. She later extended her leave to remain as an entrepreneur under Tier 1 of the Points Based System (which covers visas for working in the UK) and that was granted. She was therefore able to apply for indefinite leave to remain on the basis of the long residence. In the course of her 13 years of residence in the UK she had some absences from the UK and we provided full information of the periods in which she was absent, but she was not outside the UK for a single period exceeding six months during the calculation periods. Her application was successful.
