We assisted a South African national who was the partner of a Spanish national.  Our client petitioned for the dissolution of the civil partnership and thereafter we made an application for retention of rights of residence.  Regulation 10(5) of the EU Regulations state that a family member who has retained his right of residence will be able to remain in the UK after the dissolution of the civil partnership.  As the civil partnership lasted for three years, until the initiation of the dissolution of the civil partnership, and given that the former partner had permanent residence in the UK, and that our client was working at the time of the dissolution, his application for retention of rights was successful.
