We have assisted a national of Bangladesh who challenged the Home Office decision to refuse his human rights claim. The Secretary of State alleged that he fraudulently obtained an ETS English language certificate. However, the Secretary of State was wrong and in addition to that, the Secretary of State failed to take into account that he will risk persecution if returned to Bangladesh on account of being an atheist. In reaching the conclusion not to grant him leave, the Secretary of State failed to consider the evidence submitted in support of this application, and in particular the country expert report and the letter from Humanist UK.
