We are assisting a Russian national who entered the UK as a visitor. He is financially and emotionally dependent on his mother who is a Russian national, married to an EU national, who has permanent residence in the UK. The son and mother have lived apart, but given that the applicant is physically and emotionally unwell, as well as financially supported by his mother, we are making an application for him to be granted leave to remain under Regulation 7(1)(b) of the Immigration (European Economic Area) Regulations 2016. He is a direct family member because he is a direct descendant of the spouse of an EA national and although he is over the age of 21, he is dependent on the mother. As such he will be granted a five-year residence permit.
