The High Court suspended, in March 2019, the Home Office removal policy with immediate effect. This decision means that the system of giving migrants “removal windows” within which they can be removed from the UK without warning will be halted for at least the next few weeks. The case was brought by the charity Medical Justice, challenging the lawfulness of the policy and they were granted interim relief.
A similar injunction was granted in 2010 in a case called Medical Justice 2010 and, in that case, the High Court declared that parts of the removal policy in force at the time were unlawful. The substantive Judicial Review challenge will be heard in June or July 2019.
